Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Soul Shine Stylist ("Soul Shine Stylist," "we," "us," or "our"). By accessing or using our website at soulshinesstylist.com (the "Site"), completing an appointment booking, or receiving services at our location, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

If you do not agree to these Terms, you must not use our Site, book an appointment, or receive our services. If you are booking on behalf of a minor, you represent that you are their parent or legal guardian and agree to these Terms on their behalf.

Definitions

"Appointment" means a scheduled session for the provision of hair styling or related services at our salon location.
"Services" means all hair styling, coloring, cutting, treatment, and related personal care services provided by Soul Shine Stylist.
"Site" means the website located at soulshinesstylist.com and all associated pages.
"Booking Platform" means the third-party online scheduling system used to book Appointments.
"Cancellation Window" means the 48-hour period immediately preceding a scheduled Appointment.

Eligibility

Our Site and Services are available to individuals aged 13 and over. By using the Site, you represent and warrant that you meet this age requirement. Clients under the age of 18 must have a parent or legal guardian present at the time of service, and that guardian must agree to these Terms on the client's behalf.

We reserve the right to refuse service or deny access to the Site to anyone at our sole discretion in accordance with applicable law.

Appointments & Bookings

All Appointments must be scheduled through our Booking Platform. By completing a booking, you represent that all information provided is accurate and complete, and that you agree to these Terms.

Appointments are confirmed upon receipt of a confirmation notice from our Booking Platform. We reserve the right to decline or cancel a booking at our sole discretion, in which case any prepaid fees will be refunded in full.

New clients may be required to complete a client intake form prior to their first Appointment. This information is used solely to personalize and optimize your service experience.

All Services listed on our Services page include a consultation. It is your responsibility to communicate your hair history, including any prior chemical treatments, known allergies, or sensitivities, before services commence.

Cancellation, Rescheduling & Late Arrival

We require a minimum of 48 hours' advance notice for all cancellations and rescheduling requests. The following fees and conditions apply:

Cancellations or rescheduling requests made within the Cancellation Window (less than 48 hours before the scheduled Appointment) will incur a fee of 50% of the total value of services booked
No-shows — defined as failure to attend a scheduled Appointment without prior notice — will be charged 100% of the total value of services booked
Clients arriving more than 15 minutes past their scheduled Appointment time may have their blowdry portion of the service forfeited at our discretion
Clients arriving more than 15 minutes late may be required to reschedule their Appointment; a fee of 50% of the total services booked will apply in such cases
Repeated late cancellations or no-shows may result in the requirement of a non-refundable deposit to secure future Appointments

Pricing & Payment

All prices displayed on our Services page are base prices and are subject to change without notice. Final pricing will be confirmed at or before the commencement of services and may be higher than the listed base price based on:

Hair length, density, or thickness requiring additional product or time
Additional services requested or required during the Appointment
Extended service time beyond standard estimates

We will communicate any anticipated price adjustments before services commence. Payment in full is due at the time of service. We reserve the right to require a deposit to secure Appointments, particularly for new clients or services of significant duration or cost.

All payments are processed through our Booking Platform's payment processor. We do not store payment card information directly. By providing payment information, you authorize us to charge the applicable fees for services rendered.

All fees are non-refundable once services have been rendered, except as expressly provided in Section 7.

Service Results & Client Responsibility

Hair services — particularly color, bleach, and chemical treatments — involve variables that may affect outcomes, including but not limited to your hair's current condition, prior chemical history, natural pigment levels, and hair porosity. While we apply professional skill and judgment to every service, we cannot guarantee specific results.

It is your responsibility to:

Disclose complete and accurate information about your hair history, including all prior chemical treatments, during consultation
Communicate your desired outcome clearly and review the consultation summary before services commence
Notify us of any known allergies, scalp conditions, or sensitivities prior to your Appointment

If you are dissatisfied with a service, you must notify us in writing within 7 calendar days of your Appointment date. We will work with you in good faith to address the concern, which may include a complimentary adjustment service at our discretion. Dissatisfaction does not entitle you to a refund of services already rendered unless the dissatisfaction results directly from our failure to perform the agreed service.

We are not liable for results that differ from expectations due to undisclosed hair history or factors outside our reasonable control.

Health, Safety & Chemical Services

Certain Services involve chemical treatments including, but not limited to, bleach, hair color, toners, and conditioning treatments. By booking a chemical service, you acknowledge the following:

You have disclosed all known allergies, scalp conditions, prior chemical treatments, and any medications or health conditions that may affect your hair or scalp's response to chemical services
You understand that chemical services carry inherent risks including, but not limited to, scalp sensitivity, unexpected color results, and potential hair damage if your hair has been previously over-processed
We reserve the right to refuse or modify a chemical service if, in our professional judgment, proceeding poses an unreasonable risk to your hair or scalp health

For bleach services where more than 6 weeks of grow-out is present, a pre-Appointment consultation may be required before booking can be confirmed.

We are not liable for adverse reactions or outcomes resulting from information you failed to disclose prior to the service.

Right to Refuse Service

We reserve the right to refuse or discontinue service to any client at our sole discretion, provided such refusal is not based on any characteristic protected under applicable federal, state, or local law. Grounds for refusal may include, but are not limited to, abusive or threatening behavior toward staff, failure to disclose material hair history that affects safe service delivery, or failure to comply with these Terms.

Children & Minors

Haircut services are available to clients of all ages, with the following conditions:

We do not offer haircut services for young children who are unable to sit independently through a full service
Standard pricing applies to all clients regardless of age
Clients under the age of 18 must be accompanied by a parent or legal guardian throughout the duration of the Appointment
The accompanying parent or legal guardian must acknowledge and agree to these Terms before services commence

Photography & Social Media

We may photograph client hair results before and/or after Appointments for portfolio, marketing, or educational purposes. We will request your verbal or written consent prior to taking any photographs. You may decline without affecting the quality of your service.

By providing consent, you grant Soul Shine Stylist a non-exclusive, royalty-free, worldwide license to use, reproduce, and publish such photographs on our website and social media platforms, with appropriate attribution.

If you share photographs of your results on social media and tag our accounts, you grant us permission to reshare that content on our own platforms. You may revoke this permission at any time by notifying us in writing.

We will not use photographs that identify you personally — including facial images — without explicit written consent.

Intellectual Property

All content on the Site — including text, graphics, logos, photographs, and branding — is the exclusive property of Soul Shine Stylist or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written permission.

Nothing in these Terms grants you any right, title, or interest in our intellectual property beyond the limited license to access and use the Site for the purpose of booking and receiving Services.

Disclaimer of Warranties

THE SITE AND ALL CONTENT THEREIN ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SOUL SHINE STYLIST DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information on the Site.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SOUL SHINE STYLIST, ITS OWNER, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR RECEIPT OF SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall our total cumulative liability to you for any and all claims arising out of or related to a specific service exceed the total amount actually paid by you for that service.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the greatest extent permitted by applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless Soul Shine Stylist and its owner, agents, and representatives from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in connection with: (a) your use of the Site or Services; (b) your violation of these Terms; (c) your provision of false, incomplete, or misleading information; or (d) your infringement of any third-party rights.

Dispute Resolution & Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.

In the event of any dispute arising from or relating to these Terms or your use of our Services, the parties agree to first attempt to resolve the dispute informally by contacting us at soulshinesstylist@gmail.com. If informal resolution is not achieved within 30 days, the dispute shall be submitted to binding arbitration in San Francisco County, California, in accordance with the rules of the American Arbitration Association, unless both parties mutually agree to an alternative resolution method.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent or restrain a breach of these Terms. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

Modifications to Terms

We reserve the right to modify these Terms at any time at our sole discretion. Changes will be posted to this page with an updated "Last Updated" date. For material changes, we will make reasonable efforts to provide notice, such as by email or a prominent notice on the Site.

Your continued use of the Site or booking of Services after any changes are posted constitutes your binding acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Site and Services.

Severability & Entire Agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity of the remaining provisions.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Soul Shine Stylist with respect to your use of the Site and Services, and supersede all prior or contemporaneous communications, representations, or agreements, whether written or oral, relating to the same subject matter.
